ACCOMMODATION

  1. General

These Terms & Conditions govern all room reservations, accommodation services, and guest stays at Ramada Encore Rajbagh, Srinagar (“Hotel”).

By making a reservation, checking in, occupying a room, visiting Hotel facilities, or otherwise using Hotel services, the guest agrees to be bound by these Terms & Conditions.

  1. Reservations
  • Reservations are subject to availability.
  • Reservation confirmation is subject to receipt of applicable deposits, prepayments, guarantees, or credit approvals where required.
  • The Hotel reserves the right to refuse, modify, or cancel reservations where permitted by law.
  • The person making the reservation shall be responsible for all occupants covered under the booking.
  1. Rates & Taxes
  • Rates are quoted in Indian Rupees (INR).
  • Applicable GST and government taxes shall be charged at prevailing rates.
  • Rates may vary by season, demand, occupancy, booking channel, promotional offers, and market conditions.
  • The Hotel reserves the right to correct pricing errors, typographical errors, calculation errors, and technical system errors.
  1. Payment Policy

The Hotel may require:

  • Full advance payment
  • Partial advance payment
  • Security deposit
  • Credit card guarantee
  • Corporate guarantee

Payment verification may be required prior to check-in.

The Hotel reserves the right to pre-authorize payment cards.

  1. Cancellation, Modification, No-Show & Early Departure

Cancellation Policy

Cancellation terms vary depending on:

  • Flexible rates
  • Promotional rates
  • Corporate rates
  • Package bookings
  • Group bookings
  • Third-party bookings
  • Non-refundable offers

The cancellation terms displayed at the time of booking and stated in the booking confirmation shall apply.

Standard Flexible Reservation

Unless otherwise stated:

  • Cancellation up to 24 hours before check-in may be accepted without charge.
  • Cancellation within 24 hours of check-in may attract retention of one night’s room charge plus applicable taxes.

Non-Refundable Reservations

Certain promotional and discounted reservations may be strictly non-refundable and non-amendable.

Reservation Modifications

Changes are subject to:

  • Availability
  • Rate differences
  • Applicable taxes
  • Additional charges

No-Show Policy

Failure to arrive without prior cancellation may result in:

  • No-show charges;
  • Retention of advance deposits;
  • Automatic cancellation of remaining nights.

Early Departure

The Hotel may apply early departure charges. Refunds are not guaranteed.

OTA & Third-Party Reservations

Reservations made through:

  • Booking.com
  • Expedia
  • Agoda
  • MakeMyTrip
  • Goibibo
  • Cleartrip
  • Yatra
  • EaseMyTrip
  • Travel Agents
  • Corporate Travel Portals

shall remain subject to the cancellation and refund policies of such booking providers.

Refunds may need to be processed through the original booking channel.

  1. Check-In & Check-Out

Check-In: 2:00 PM, Check-Out: 12:00 Noon

Early check-in and late check-out are: subject to availability; not guaranteed; chargeable where applicable.

  1. Identification Requirements

All guests must present valid Government-issued photo identification.

Indian Nationals

  • Aadhaar Card, Passport, Driving Licence, Voter ID Card

Foreign Nationals/NRI

  • Passport, Valid Visa, OCI, Additional documentation required by Indian authorities

The Hotel reserves the right to refuse accommodation where identity requirements are not met.

  1. Occupancy Policy
  • Occupancy limits shall be determined by room category, fire regulations, and Hotel policy.
  • Additional charges may apply for extra occupants.
  • Unregistered guests shall not stay overnight without authorization.
  1. Visitor Policy
  • Visitors may be required to register and produce valid identification.
  • Visitor access is subject to Hotel policy.
  • The Hotel reserves the right to deny access for operational, privacy, safety, or security reasons.
  1. Guest Privacy & Safety

The Hotel endeavors to protect guest privacy and confidentiality.

  • Guest room numbers shall not ordinarily be disclosed to unauthorized persons.
  • Stay details may remain confidential except where disclosure is required by law.
  • CCTV may operate in designated public areas.

Nothing in these Terms constitutes a guarantee of personal safety or security.

  1. Solo Travelers & Women Guests

The Hotel endeavors to maintain a safe, respectful, and welcoming environment for all guests including women travelling alone.

The Hotel may:

  • Verify visitor identity prior to granting access;
  • Restrict disclosure of guest information;
  • Provide assistance through Front Office, Security, and Management personnel.
  1. Smoking & Prohibited Substances
  • Smoking is permitted only in designated smoking areas.
  • Smoking in prohibited areas may attract cleaning and restoration charges.
  • Vaping, hookah, sheesha, narcotics, illegal substances, and prohibited materials are not permitted.
  1. Guest Conduct

Guests shall not:

  • Disturb other guests; Engage in unlawful activities;
  • Harass guests or employees; Damage Hotel property;
  • Conduct unauthorized commercial activities.

The Hotel reserves the right to remove guests without refund where necessary.

  1. Parking
  • Parking is subject to availability. Parking is provided at the vehicle owner’s risk.
  • The Hotel is not responsible for vehicle damage, theft, or loss.
  1. Lost & Found

The Hotel shall not be responsible for lost, damaged, or stolen items.

Recovered items may be retained according to Hotel policy.

  1. Photography & Social Media

Personal photography is generally permitted provided:

  • Other guests’ privacy is respected; Hotel operations are not disrupted.
  • Commercial photography requires prior approval.
  1. Limitation of Liability

To the maximum extent permitted by law:

The Hotel shall not be liable for:

  • Indirect losses; Consequential losses; Business interruption; Loss of profits; Loss of opportunity;
  • Third-party actions; Internet interruptions;
  • Vehicle damage; Theft not attributable to Hotel negligence.
  1. Force Majeure

The Hotel shall not be liable for events beyond its reasonable control including:

  • Government restrictions; Curfews; Security advisories; Natural disasters; Epidemics;
  • Pandemics; Utility failures; Civil disturbances.
  1. Privacy

Personal Data shall be processed in accordance with the Hotel Privacy Notice.

  1. Governing Law & Jurisdiction

These Terms are governed by the laws of India.

Exclusive jurisdiction shall lie with the Courts of Srinagar, Jammu & Kashmir.

EVENT, BANQUET & MEETING TERMS & CONDITIONS:

  1. General

These Terms & Conditions govern all events, banquets, conferences, meetings, exhibitions, weddings, social gatherings, corporate events, training sessions, workshops, product launches, promotions, and related functions conducted at Ramada Encore Rajbagh, Srinagar (“Hotel”).

By making a booking, paying an advance, signing a proposal, issuing a purchase order, conducting an event, or utilizing any Hotel venue or facility, the Organizer agrees to these Terms & Conditions.

  1. Booking Confirmation
  • Bookings are tentative until confirmed by the Hotel in writing.
  • Confirmation shall be subject to receipt of the required advance payment.
  • The Hotel reserves the right to release tentative bookings without notice if payment is not received within the stipulated timeline.
  • Event dates, venues, and rates are subject to availability at the time of confirmation.
  1. Advance Payment & Billing
  • Advance payment requirements shall be communicated in the proposal or contract.
  • The Hotel reserves the right to require milestone payments before the event date.
  • All outstanding balances must be settled before completion of the event unless otherwise agreed in writing.
  • The Hotel reserves the right to suspend services for overdue payments.
  1. Guaranteed Attendance
  • Final guest count must be communicated in writing within the timeline specified by the Hotel.
  • Billing may be based on the guaranteed attendance or actual attendance, whichever is higher.
  • Significant reductions in guest count shall not automatically reduce the guaranteed minimum commitment.
  1. Cancellation by Organizer

Unless otherwise agreed in writing:

  • More than 90 days before the event: Advance payable may be forfeited.
  • 31 to 90 days before the event: Up to 50% of estimated event value may be charged.
  • 15 to 30 days before the event: Up to 75% of estimated event value may be charged.
  • 14 days or less before the event: Up to 100% of estimated event value may be charged.

The Hotel reserves the right to determine actual losses and recover applicable charges.

  1. Venue Usage
  • The venue shall be used only for the approved event purpose.
  • The Hotel reserves the right of admission.
  • Entry may be restricted, regulated, or denied to maintain security, privacy, safety, and decorum.
  • The Organizer shall ensure that all invitees comply with Hotel policies.
  1. Venue Blocking & Occupancy

Standard Timings:

Lunch Function: 11:00 AM to 4:00 PM

Dinner Function: 7:00 PM to 11:00 PM

  • Extended usage is subject to approval and additional charges.
  • Setup, rehearsals, decoration, vendor loading, and dismantling outside the allotted period may attract additional charges.
  • Venue blocking for prior-day setup may attract up to 100% additional venue rental charges.
  1. Food & Beverage Policy
  • Outside food and beverages are strictly prohibited unless specifically authorized in writing by the Hotel.
  • All Hotel-supplied food and beverages must be consumed within the Hotel premises.
  • Consumption of food prepared outside the Hotel may be prohibited due to food safety requirements.
  1. Alcohol & Excise Compliance
  • The Hotel does not arrange liquor licenses unless specifically agreed in writing.
  • Where alcohol service is permitted, the Organizer shall obtain all necessary permissions and licenses.
  • The Organizer assumes sole responsibility for compliance with Jammu & Kashmir Excise laws.
  • Alcohol service may be restricted, regulated, or prohibited at the sole discretion of the Hotel.

The Hotel shall not be responsible for penalties, violations, fines, or consequences resulting from unlawful alcohol service.

  1. Music, Entertainment & Copyright Licensing
  • Music and entertainment must comply with government regulations and permitted timings.
  • Organizers shall obtain all required copyright and performance licenses, including IPRS, NOVEX, PPL, or any other applicable licenses.
  • The Hotel reserves the right to reduce sound levels or discontinue entertainment that may create disturbance, legal risk, or safety concerns.
  1. Decoration, Setup & Vendor Access
  • All event designs and layouts require prior approval.
  • No drilling, nailing, stapling, painting, adhesive fixing, or permanent installation is permitted.
  • Hotel walls, flooring, ceilings, furniture, fixtures, and equipment must not be damaged.
  • The Organizer shall be responsible for all third-party decorators, technicians, performers, and vendors.
  1. Vendor Responsibility

All vendors engaged by the Organizer shall remain under the Organizer’s supervision and responsibility.

The Hotel:

  • Does not guarantee vendor performance.
  • Is not responsible for delays, defects, negligence, misconduct, or contractual disputes involving vendors.
  • May deny access to vendors who fail to comply with Hotel policies.
  1. Internet, Power & Technical Services
  • Internet services are provided on a best-effort basis.
  • Dedicated bandwidth, livestreaming connections, technical support, or special infrastructure shall be chargeable.
  • The Hotel does not guarantee uninterrupted internet connectivity.
  • Additional electrical load requirements must be communicated in advance.

Unauthorized electrical connections may be disconnected immediately.

  1. Parking
  • Parking is subject to availability.
  • Parking operates on a first-come, first-served basis.
  • Parking is provided entirely at the vehicle owner’s risk.
  • The Hotel assumes no responsibility for theft, loss, or damage to vehicles or contents.
  1. Safety & Fire Compliance

The following are prohibited unless specifically authorized:

  • Fireworks, Firearms, Explosives, Hazardous materials, Open flames
  • Smoke machines, Helium balloons, Confetti cannons

Fire exits and emergency access routes must remain unobstructed at all times.

The Hotel may stop any activity that presents a safety risk.

  1. Capacity Compliance

The Organizer shall not exceed the approved venue occupancy.

The Hotel reserves the right to:

  • Restrict entry; Limit attendance; Remove excess attendees;

to comply with legal and safety requirements.

  1. Guest Conduct & Anti-Harassment Policy

The Hotel maintains a zero-tolerance policy toward:

  • Harassment, Sexual harassment, Threats, Intimidation, Violence
  • Stalking, Bullying, Discrimination, Disorderly behaviour

This applies to:

  • Organizers, Guests, Employees, Vendors, Speakers, Attendees

The Hotel reserves the right to remove any person whose conduct is deemed inappropriate, unsafe, unlawful, or disruptive.

  1. Political Neutrality & Restricted Events

The Hotel is an apolitical establishment.

The Hotel may refuse, cancel, terminate, or suspend any event involving:

  • Political campaigning, Election-related activities, Hate speech
  • Extremist content, Activities likely to disturb public order
  • Unlawful activities, Activities that may adversely affect the Hotel’s reputation

No refunds shall be due where an event is terminated because of policy violations.

  1. Photography, Videography & Media
  • Photography and videography may be conducted within the approved event area.
  • Commercial filming requires prior written approval.
  • Drone operations are prohibited unless specifically authorized.
  • The Hotel may use photographs of venue decor, setups, banquet spaces, and ambience for promotional purposes.

Close-up images identifying individuals shall not be used where consent is legally required.

  1. Privacy & Data Protection

The Hotel may collect and process:

  • Organizer details; Billing information; Attendance information;
  • CCTV footage; Access logs; Network usage information;

for operational, security, legal, regulatory, and business purposes. Such information may be disclosed where required by law.

  1. Government Disclosure & Compliance

The Hotel may disclose information to:

  • Government authorities; Law enforcement agencies; Courts; Regulatory authorities;
  • Where legally required. Such disclosures shall not constitute a breach of confidentiality.
  1. Attendee Declaration & Acknowledgement

By attending, participating in, registering for, or otherwise taking part in any event conducted at the Hotel, attendees acknowledge and agree that:

  1. Participation is voluntary.
  2. Any purchase, investment, membership, employment application, healthcare consultation, insurance purchase, timeshare enrollment, real estate transaction, financial transaction, or other engagement is undertaken solely at the attendee’s own risk and discretion.
  3. The Hotel is acting solely as the venue provider. The Hotel does not endorse, verify, certify, or guarantee any statement, service, offer, product, advice, or representation made during the event.
  4. The Organizer remains solely responsible for the event and its contents.
  5. Any dispute arising from the event shall be addressed solely against the Organizer or responsible party.
  6. Ramada Encore Rajbagh Srinagar, Al Habib Emporio, Wyndham Hotels & Resorts, their affiliates, management, employees, and representatives shall not be liable for any losses, claims, damages, or liabilities arising from participation in the event.
  7. Attendance constitutes acceptance of these Terms.
  1. Damage & Recovery

The Organizer shall be liable for all loss or damage caused by:

  • Guests, Invitees, Vendors, Contractors, Attendees

The Hotel may recover:

  • Repair costs, Replacement costs, Cleaning costs
  • Revenue loss resulting from damage
  1. Indemnity

The Organizer agrees to indemnify and hold harmless:

  • Al Habib Emporio, Ramada Encore Rajbagh Srinagar, Wyndham Hotels & Resorts
  • Directors, Employees, Agents, Representatives

against all claims, liabilities, losses, damages, costs, penalties, and legal expenses arising from:

  • The Event; Organizer’s actions; Attendee conduct; Vendor actions;
  • Breach of law; Breach of these Terms.
  1. Limitation of Liability

To the maximum extent permitted by law:

The aggregate liability of the Hotel shall not exceed the amount actually paid to the Hotel for the specific event booking.

The Hotel shall not be liable for:

  • Loss of profit; Loss of business; Reputational harm; Indirect losses; Consequential losses; Third-party actions;
  • Vendor failures; Internet failures; Utility interruptions.
  1. Force Majeure

The Hotel shall not be liable for delays, interruptions, cancellations, or non-performance resulting from circumstances beyond its reasonable control including:

  • Government restrictions, Curfews, Security advisories, Natural disasters
  • Floods, Earthquakes, Power failures, Pandemics, Epidemics, Civil disturbances, Strikes, Acts of terrorism

Equipment Failure, Technical Malfunction & Service Interruption

  • While the Hotel endeavors to maintain all equipment, facilities, infrastructure, systems, utilities, and services in proper working condition, the Organizer acknowledges and agrees that the Hotel does not guarantee uninterrupted or error-free operation of any equipment, technology, utility, or service.
  • The Hotel shall not be liable for any loss, delay, interruption, inconvenience, claim, cost, expense, damage, business interruption, reputational impact, or consequential loss arising from:
  • Failure or malfunction of audio-visual equipment;
  • Microphone, sound system, projector, display screen, LED wall, lighting, staging, or presentation equipment failures;
  • Internet interruptions or bandwidth limitations;
  • Wi-Fi outages; Livestreaming failures; Software or hardware malfunctions; Electrical fluctuations or disruptions;
  • Generator or backup power limitations; Telecommunication failures;
  • Third-party vendor equipment failures; Technology compatibility issues;
  • Utility interruptions beyond the reasonable control of the Hotel.
  • The Organizer is encouraged to test all event-related equipment and systems prior to the Event and to arrange appropriate backup systems where continuity is critical.
  • Where equipment or technical services are provided by third-party vendors, the Hotel shall not be responsible for the quality, suitability, performance, maintenance, operation, or failure of such equipment or services.
  • In the event of any equipment malfunction or service interruption, the Hotel shall use commercially reasonable efforts to restore service or provide alternative arrangements where reasonably practicable; however, the Hotel shall not be obligated to provide compensation, damages, refunds, or reductions in charges except where expressly agreed in writing or required by applicable law.
  • The Organizer acknowledges that technology-based services, including internet connectivity, wireless communications, livestreaming, digital presentations, and audio-visual systems, are subject to inherent operational risks and limitations.
  1. Event Cancellation by Hotel

The Hotel reserves the right to cancel, postpone, terminate, or suspend an event where:

  • Required payments are not received; Event details were misrepresented;
  • Legal risks arise; Security concerns arise; Government directives require restrictions;
  • The Organizer breaches these Terms.

Any refund shall be subject to Hotel policy and applicable law.

  1. Governing Law & Jurisdiction

These Terms shall be governed exclusively by the laws of India.

Any dispute shall be subject to the exclusive jurisdiction of the competent Courts of Srinagar, Jammu & Kashmir.

Acceptance

Payment of any advance, issuance of purchase orders, confirmation of booking, execution of event agreements, event registration, attendance, participation, or use of Hotel facilities shall constitute acceptance of these Terms & Conditions.
